What is TPD all about; and why does it concern me?

What is the Tobacco Products Directive? 

The Tobacco Products Directive (TPD) or European Tobacco Products Directive (EUTPD) (2014/40/EU) is a directive of the European Union.

This directive regulates the sale and merchandising of all tobacco and tobacco related products across the EU. The TPD aims to ensure that a high level of health protection is in place for European citizens. The Directive came into force on 19th May 2014 and has became applicable in the EU Member States on 20th May 2016.

This Directive covers a number of areas including; the manufacture, presentation, and sale of all tobacco related products including cigarettes, roll your own tobacco, and electronic cigarettes. Due to the situation, the European Union and its Member States have put in place various tobacco control measures in the form of legislation, recommendations and awareness campaigns.

The policies for the Tobacco Products Directive cover; the regulation of tobacco products on the EU market (e.g. details for packaging, labelling, and listing ingredients), advertising restrictions for tobacco products, the creation of smoke-free environments, additional tax measures and activities against illegal trade, and acquiring anti-smoking campaigns.

The TPD introduced new rules directly concerning e-cigarettes which ensure:

§  Standards for safety and quality

§  Additional information for consumers regarding products containing nicotine.

§  That steps and preventive measured are put in place to protect children from starting to use the products.

 

 

The new rules?
As of May 2017, any nicotine containing product relating to e-cigarettes/vaping must:
Restrict the maximum volume of single containers of e-liquid to 10ml
 
Restrict the capacity to 2ml for tanks
 
Restrict the nicotine strength to 20mg/ml in e-liquids.
 
All containers to be tamper proof and child resistant
 
VAPES should not contain caffeine, taurine or colourings
 
 
All vapes should be submitted to the MHRA before they can be sold
 
Relevant warnings must be marked on the products and clear information
 
Between the directive May 2016, and  of May 2017, retailers were encouraged to sell any stocks of products that would not comply with the new TPD. 

Fron May 2017, you should not be able to purchase non-compliant products within the EU. For this reason, you may have seen the removal of certain brands from the shelves. In most cases this was due to the manufacturer not being able to comply with the new requirements in time.
